SNI or Indonesian National Standard is a series of technical guidelines and specifications issued by the National Standardization Body (BSN) of the Republic of Indonesia. SNI is designed to ensure the quality, safety and compliance of products, processes and services in Indonesia. SNI can be carried out voluntarily based on need, where business actors who are able to implement SNI can apply for certification to the Conformity Assessment Institute (“LPK”) which has been accredited by the National Accreditation Committee (“KAN”). This certification is a series of conformity assessment activities related to providing written guarantees that goods, services, systems, processes or personnel have met the standards and/or regulations set by BSN and applicable in the territory of Indonesia. Furthermore, Indonesian National Standard product certification will be provided by LPK by providing certificates to applicants who have met SNI requirements.
What will be affixed to the product when it has obtained SNI is the SNI Mark and/or the Conformity Mark on the goods, packaging or label. The SNI mark and/or conformity mark for services, systems, processes, and/or personnel can be affixed to identification boards, letterheads, and/or other media. [8] Furthermore, affixing is carried out after the business actor has received approval for the use of the SNI mark and/or conformity mark from BSN.
Is SNI mandatory for every product circulating in Indonesia?
Mandatory implementation of SNI for producers is carried out by ministers and/or heads of non-ministerial government institutions by considering:
- safety, security, health and preservation of environmental functions;
- competitiveness of national producers and healthy business competition;
- capability and readiness of the national business world;
- LPK infrastructure readiness;
- culture, customs or traditions based on local wisdom; and/or
- other national interests in accordance with the provisions of laws and regulations.
If SNI is required for goods, services, systems or processes, then business actors, ministries/non-ministerial government agencies, and/or regional governments are required to have certificates for those goods, services, systems or processes.
Business actors who produce, produce and/or import goods for which SNI has been compulsorily applied are required to affix the SNI mark and/or conformity mark on goods and/or packaging or labels that will be traded and/or distributed in the territory of Indonesia . This obligation is excluded in the event that the business actor producing and/or producing goods has made an agreement with the business actor who owns the registered mark and/or the recipient of the registered mark license that the affixing of the SNI mark and/or conformity mark is carried out by the business actor who owns the registered mark and/or or registered trademark licensee .
As applies to the voluntary application of SNI, the affixing of the SNI mark and/or conformity mark to the SNI which is compulsorily applied is also carried out after obtaining approval for the use of the SNI mark and/or conformity mark given by BSN to business actors.
SNI is mandatory, applied to business actors who trade:
- Goods that have been marked with SNI and/or conformity marks on the goods and/or packaging or labels; and/or
- Services that have an Indonesian National Standard certificate.
WHAT ARE THE SANCTIONS IF YOU VIOLATE?
If this obligation is violated, the business actor is obliged to stop trading activities in goods and/or services . Apart from that, if the business actor does not fulfill the mandatory SNI and does not affix the SNI mark and/or conformity mark, then the business actor is obliged to withdraw the goods from.
The following are some examples of goods that require SNI:
- Ban , which is enforced through Minister of Industry Regulation Number 76/M-IND/PER/9/2015 of 2015 concerning Mandatory Implementation of the Indonesian National Tire Standard . Product Certificate for Using the SNI Tire Mark is a certificate issued by the Product Certification Institute (“LSPro”) to manufacturers who are able to produce tires in accordance with SNI tire requirements.
The types of tire products that must include SNI include:
- Passenger car tires;
- Light truck tires;
- Truck and bus tires;
- Motorcycle tires;
- Motor vehicle inner tires;
- Tires that have been installed on the rim.
- Helmets , which are enforced through the Minister of Industry Regulation Number 79/M-IND/PER/9/2015 of 2015 concerning the Mandatory Implementation of the Indonesian National Standard for Helmets for Motorized Two-Wheeled Vehicles . Product Certificate for Using the SNI Mark for Two-Wheeled Motorized Vehicle Rider Helmets is a certificate issued by LSPro to manufacturers who are capable of producing two-wheeled motorized vehicle rider helmets in accordance with SNI helmet requirements.
- Cement , which is enforced through the Minister of Industry Regulation Number 82/M-IND/PER/9/2015 of 2015 concerning Mandatory Implementation of the Indonesian National Cement Standard . Product Certificate for Using the SNI Cement Mark is a certificate issued by LSPro to producers who are capable of producing cement in accordance with SNI requirements.
- Mineral water, demineral water, natural mineral water, and dew drinking water are enforced through Minister of Industry Regulation Number 78/M-IND/PER/11/2016 of 2016 concerning Implementation of the Indonesian National Standard for Mineral Water, Demineral Water, Natural Mineral Water, and Compulsory Dew Drinking Water as amended by Minister of Industry Regulation Number 26 of 2019 concerning Amendments to Regulation of the Minister of Industry Number 78/M-IND/PER/11/2016 concerning Implementation of Indonesian National Standards for Mineral Water, Demineral Water, Natural Mineral Water and Drinking Water Mandatory Dew . A Product Certificate for Using the SNI Mark is a certificate issued by LSPro to producers who are capable of producing mineral water, demineralized water, natural mineral water and dew drinking water according to SNI requirements. The types of water products that must be included in SNI include:
- Mineral water
- Demineralized water
- Natural mineral water
- Dew drinking water
As additional information, specifically for Micro and Small Enterprises (“UMK”) whose business activities are low risk, these MSEs only need to take care of their Business Identification Number (“NIB”) without needing to take care of SNI anymore. This is because the NIB for low-risk business activities carried out by MSEs, functions as the identity of business actors, legality for carrying out business activities, and also applies as SNI and a halal guarantee statement.
